IN EXERCISE of the powers conferred by Section 28 of the National Insurance Act,

THE NATIONAL INSURANCE (BENEFITS) (AMENDMENT) REGULATIONS 2005

1. (1) These Regulations may be cited as the National Insurance (Benefits) (Amendment) Regulations 2005.

(2) These Regulations shall be deemed to have come into Force on the 1st July 2005.{{more}}

2. Regulation 2 of the National Insurance (Benefits) Regulations, 1994, in these Regulations referred to as the “principal Regulations”, is amended by deleting in the definition of “insurable earnings” the words “$870.00 weekly or $3,770.00 monthly” and inserting the words “one thousand dollars weekly or four thousand three hundred and thirty three dollars monthly”.

3. Regulation 23 of the principal Regulations is amended in Subregulation (1) by deleting the words “five hundred dollars” and inserting the words “five hundred and fifty dollars”.

4. Regulation 35 of the principal Regulations is amended in subregulation (2) by deleting the words “fifty-five dollars” and inserting the words “sixty dollars”.

5. Regulation 37A of the principal Regulations is amended in subregulation (1) by deleting the words “twenty dollars” and inserting the words “thirty dollars”.

6. Regulation 51 of the principal Regulation; is amended by inserting after subregulation (3) the following new subregulation “

“(4) Pensions awarded prior to the 1st January 2005 in accordance with regulations 28, 33, 37 and 42 are increased three per centum for every year (or part of a year) from the 3lst December 2002 or the date of the award, whichever is the later, up to a maximum increase of six per centum”.

7. The Third Schedule to the principal Regulations is repealed and the following substituted

FUNERAL GRANTS

A. Non-Contributory Assistance Age Pensioner

The amount of a funeral grant shall be

(a) With respect to the death of a Non-Contributory

Assistance Age Pensioner $1,900.00;

(b) With respect to the death of the spouse of a Non-contributory.

Assistance Age Pensioner $950.00;

(c) With respect to the death of a dependant child of a Non-Contributory Assistance Age Pensioner, based on the age of the child at death –

B. General

The amount of a funeral grant shall be –

(a) With respect to the death of an insured person, an invalidity pensioner, or an age pensioner $ 3,800.00;

(b) With respect to the death of the spouse of an insured person, an invalidity pensioner, at an age pensioner $1,900.00;

(c) With respect to the death of a dependant child of an Insured person, an invalidity pensioner, or an age pensioner based on the age of the child at death –

3 years $ 570.00

4 years $760.00

5 years $950.00

6 years $1140.00

7 years $1330.00

8 years $1520.00

9 years $1710.00

10 years and over $1900.00

8. The pension distributed by the National Insurance Services as Non-Contributory Assistance Age Pension of twenty five dollars per week: under the purported authority of regulation 37 A of the National Insurance (Benefits) Regulations 1994 is declared to have been validly, properly and lawfully distributed and all persons distributing under regulation 37 A on behalf of the National Insurance Services are freed, acquitted, discharged and indemnified as well against the Queen’s Most Excellent Majesty, Her Heirs and Successors as against all other persons from proceedings of any kind in respect of or consequent on distributing such pensions.

IN EXERCISE of the powers conferred by Sections 27 and 28 of the National Insurance Act (Cap. 229), the Minister makes the following Regulations –

THE NATIONAL INSURANCE (EMPLOYMENT INJURY BENEFITS) (AMENDMENT) REGULATIONS 2005

1. (1) These Regulations may be cited as the National Insurance (Employment Injury Benefits) (Amendment) Regulations 2005.

(2) These Regulations shall be deemed to have come into force on lst ofJuly 2005.

2. Regulation 21 of the National Insurance (Employment Injury Benefits) Regulations 1997 is amended in subregulation (3) by deleting the words “$3,000.00” and inserting the words “three thousand eight hundred dollars”.
