Man jailed for rape gets new sentence for assault and burglary
A man who broke into his cousin’s home late at night while she was asleep with her five year old daughter was jailed for eight years and six months.
Shone Bynoe, a man who was jailed last year for raping a 14 year old girl in a cemetery, will now serve this latest sentence after he finishes his 14 years for rape.
The Lowmans Leeward man who pleaded guilty to the offences of aggravated burglary and assault causing bodily harm was sentenced at the High Court #2 on July, 21.
After 10 days spent on remand were deducted from his sentence, Bynoe was sentenced to eight years, six months, and 20 says for burglary, and one year and 20 days for assault. Both of these sentences will run concurrently.
According to the facts presented by Justice Rickie Burnett, the virtual complainant, Niketa Warren, and Bynoe are cousins and has been acquainted for more than 20 years.
Warren resided in Lowmans Hill where she occupied the downstairs of a two-storey building owned by her father, Reynold Morgan, who lives upstairs.
On the night of July 9, 2021, she was at her home with her then five year-old daughter. She closed her door at about 8:00 p.m., and they fell asleep. At approximately 2:00 a.m., Warren was awakened by the movements and sounds of her front door. She stood, observed the door and saw the hook was being removed with a knife which was piercing through the door. She secured the hook once more and returned to lie down.
Afterwards, she noticed that the hook was removed again and Bynoe walked into the house with the knife in his right hand. He was bareback and wearing a short red pants at the time.
He approached the woman, and a scuffle ensued between them. She managed to get the knife away and she ran outside to seek assistance . As she ran, she screamed for help and her father heard her cries and upon peering outside, saw the prisoner on the steps of his home. .
The police later arrived and Warren subsequently visited the hospital where an examination revealed that she sustained an abrasion to her finger, and tenderness was also noted in the area.
Later that morning, the Bynoe was taken into custody and was later arrested and charged.
In handing down the sentence for burglary, Justice Burnett found that the consequences of the offence fell into category two. This was because Bynoe entered the home while the woman was asleep with a minor. The complainant also now suffers psychological harm; she and daughter are paranoid and have trust issues. She also eventually had to move from the apartment.
As it relates to the seriousness of the offence, this fell into the highest category because a weapon, namely a knife, was used.
This brought the judge to a starting point of 12 years.
When he examined the aggravating factors of the offence, he found that Bynoe was equipped with a weapon.
There were no mitigating factors of the offence.
As for Bynoe as an offender, he has multiple, previous convictions; there were no mitigating factors of him.
As a result his one year was added to his sentence.
His guilty plea went to his credit, and he was afforded a one-third discount, which took the sentence down to eight years and seven moths before time spent on remand was deducted.
For his sentence on the charge of assault, the judge started at one year and seven months, having found that both the consequence and seriousness of the offence fell into category two.
However, Bynoe was also afforded a one-third discount for his guilty plea.
The crown was represented by counsel, Kaylia Toney, and Maria Jackson- Richards, while the defence was represented by Counsel Karl Williams.
On May 26, 2022, Bynoe pleaded guilty to charges of rape and abduction, and he was sentenced to 14 years imprisonment on the rape charge to run concurrently with a one year and eight months sentence on the abduction charge. A total of 10 months was deducted from the sentence for time he spent on remand.
Bynoe will now therefore serve his sentence for aggravated burglary and assault after he finishes serving time for rape.
