Dominic Ross fined for fracturing man’s nose
A Paul’s Avenue man was fined $1500 for fracturing a man’s nose by punching him in his face, after seeing him walking in Heritage Square with his ex-girlfriend.
Dominic Ross, 54, appeared at the Serious Offences Court on Tuesday, April 29, 2024, before Senior Magistrate, Colin John where he pleaded guilty that on March 11, 2023, at Kingstown, he did unlawfully and maliciously inflict grievous bodily harm on Micah Cumberbatch,35, of Redemption Sharpes.
The facts as read are that Cumberbatch knows Ross very well from being a customer at his business place. At about 12:05 p.m (mid-day) on the date in question, Cumberbatch was walking in Heritage square with his friend, Yacka Farrell, who is also the defendant’s ex-girlfriend.
Cumberbatch felt someone grab him by his throat from behind. He saw that the person who grabbed him was the defendant, Dominic Ross.
Ross then punched Cumberbatch in his face, fracturing his nose and told him “know way yo doing.” The matter was reported to the police.
PC 1062 Morgan entertained the report, a statement in writing was recorded from Cumberbatch, and PC Morgan carried out an investigation into the report.
On March 14, Ross arrived at the police station on the request of the police. PC Morgan identified himself to him as a police officer and informed him of the reports which were made against him.
PC Morgan later cautioned and interviewed Ross in the presence of PC 978 Haywood for the offence of grievous bodily harm.
Ross did not volunteer a statement in writing, but said that he boxed Cumberbatch, and that he would go to court and apologize to him.
Later on the same date, PC Morgan arrested and charged Ross for the offence of grievous bodily harm.
When sentencing, Senior Magistrate John said that the attack was “very much unprovoked” as Cumberbatch “was simply in the company of a female”.
John added that society speaks against violence, and violence against women. He also said that Cumberbatch’s nose could have been disfigured.
“You cannot go along and assault people like that,” John told Ross.
“At this age, you should exhibit more maturity,” he continued.
John then fined Ross the sum of $1,500 to be paid in three months, in default of which he will spend nine months in prison.
