Three years prison for unlawful sex
Alwyn Johnson will spend the next three years of his life confined to Her Majestyâs Prison, after he pleaded guilty to having unlawful sexual intercourse.{{more}}
Johnson, a carpenter of Campden Park, was slapped with the custodial sentence on Friday, May 8, 2009, at the High Court, after pleading guilty to having unlawful sexual intercourse with a girl under the age of 15 and Indecent assault on a child under the age of 15, which occurred between September and October 2007.
He was initially charged with rape, but the crown subsequently withdrew that charge.
The court heard that the victim, a 14-year-old secondary school student, lived with her mother and sister at the time of the incident.
Their next door neighbour, who had traveled overseas and had her house broken into, had asked Johnson to stay at her home while she was away. During that time, Johnsonâs daughter had come from overseas to live at the house with him. Both the virtual complainant and Johnsonâs daughter became friends over a period of time.
It was heard that the 14-year-old visited the Johnsonsâ house on several occasions to socialise with Johnsonâs daughter. After some time, Johnson started making advances on the girl by touching her breasts, buttocks and performing oral sex on her.
The accused left the neighbourâs house when she returned from overseas but still visited the neighbourâs home occasionally. She subsequently got a job at a hotel, which saw her having to leave home early on mornings and return late at nights. She made arrangements for Johnson to look after her children in her absence. It was during this time that Johnson had sexual intercourse with the 14-year-old girl on more than four occasions at the neighbourâs home between September and October 2007.
The virtual complainant eventually told her mother about what had happened between her and Johnson.
Johnson was sentenced to three years on each count, but the sentences will run concurrently.
