‘Fat Head’ walks free

Everett âFat Headâ Bynoe walked away a free man on Monday, 30 March, 2009, after Chief Magistrate Sonya Young found him not guilty of his charges.{{more}}
Bynoe, a 33-year-old resident of Belmont, was charged with having in his possession one double barrel firearm and 2 rounds of 12-gauge ammunition without a license. He had previously pleaded not guilty to the offence.
Police found both the firearm and ammunition while executing a search on Bynoeâs residence. The items were found in his yard wrapped in a plastic bag and a shirt.
During the trial, held at the Serious Offences Court, defence Lawyer Ronald Marks argued that the gun and ammunition did not belong to his client, as the yard in which they were found was not fenced, giving anyone access to it.
The Prosecution, led by Station Sergeant Nigel Butcher, however, argued that the firearm belonged to Bynoe, since he knew where it was, having pointed it out to police officers as they searched the yard.
Officers went to Bynoeâs residence with a search warrant on the morning of November 23, 2008, after receiving certain information.(OS)
