Clare Valley man fined for weed and gun
Chief Magistrate Sonya Young on Tuesday sentenced 40-year-old Clare Valley resident Carlos Franklyn to thirty months in prison after he pleaded guilty to possession of 37,682 grams (83 pounds) of cannabis.{{more}}
Franklyn pleaded not guilty to having a Winchester 12-gauge firearm and one 12-gauge shotgun cartridge on November 15, 2008, at De Volet Mountains.
The court heard that the Rapid Response Unit (RRU) went to on patrol in the De Volet Mountains where the defendant was met in a marijuana field applying manure to the plants. He was accosted by the officers and taken to a hut in the field. A search conducted by the officers met two buckets filled with material resembling cannabis. When cautioned by the police Franklyn replied: âAh helping out ah man.â
The matters that he pleaded not guilty to were adjourned to January 19, 2009. (KW)
